Using a brand does not give you exclusive rights to it. In Mexico, protection comes from registration with the Mexican Institute of Industrial Property (IMPI).
Basic steps
- Clearance search to confirm the brand is available.
- Define the classes of goods or services you will protect.
- File the application and pay the fees.
- Respond to the formal and substantive examination and, if any, oppositions.
The registration lasts 10 years, is renewable, and requires proof of use within the periods set by law.
